These terms govern purchases made through this online shop, operated by NAPKOR s.r.o., trading as NAPKOR, Dlouhá 715/38, 110 00 Hlavní město Praha, Czech Republic, Company ID (IČO) 24877964.

1. Scope

These terms apply to all orders placed through this shop. Deviating terms of the customer do not apply unless we agree to them in writing.

2. Formation of the contract

Product listings are an invitation to order and not a binding offer. By placing an order you make a binding offer to purchase. The contract is concluded when we confirm your order by email. Before submitting the order you can review and correct all entries on the checkout page; the order button is marked as creating an obligation to pay. The contract is concluded in English.

3. Prices and payment

All prices are stated in Czech koruna (CZK) and are final prices for consumers. Delivery costs are shown separately at checkout before you place the order and are set out in our Shipping policy. Payment is made using the methods displayed at checkout.

4. Delivery and passing of risk

Delivery times and costs are set out in our Shipping policy. For consumers, the risk of damage to the goods passes on delivery to you, not on hand-over to the carrier.

5. Retention of title

The goods remain our property until payment has been received in full.

6. Right of withdrawal

Consumers have a 14-day right of withdrawal as described in our Returns policy, which also contains the model withdrawal form.

7. Rights from defective performance

Statutory rights from defective performance apply under the Czech Civil Code, including the 24-month period for consumer goods. Nothing in these terms limits or excludes your statutory rights. Where a manufacturer offers an additional guarantee, its terms are supplied with the goods.

8. Assembly and safe use

Bicycles are supplied partly assembled, as delivered by the manufacturer: the handlebars, pedals, saddle and wheels usually need fitting, and brakes and gears need adjusting. Have the bicycle checked by a bicycle service before the first ride if you are not confident doing this yourself. Follow the manufacturer's instructions on load limits and on the intended use of the bicycle and of any component.

9. Product information

We state the specifications, sizes and weights supplied by the manufacturer. Checking that a product fits its intended use is the customer's responsibility; if you are unsure, ask us before ordering.

10. Liability

We are liable without limitation for damage arising from injury to life, body or health, and for intent and gross negligence. In cases of slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

11. Applicable law and disputes

Czech law applies. For consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The competent body for out-of-court settlement of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz).
